Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:
Cooling-off period: the period during which the consumer may exercise the right of withdrawal;
Consumer: the natural person who is not acting for purposes related to their trade, business, craft, or profession and enters into a distance contract with the entrepreneur;
Day: calendar day;
Continuing performance contract: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
Durable medium: any instrument that enables the consumer or entrepreneur to store information addressed personally to them in a way accessible for future reference and unchanged reproduction;
Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period;
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;
Distance contract: a contract concluded within the framework of an organized system for distance selling, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract;
Means of distance communication: any method that can be used to conclude a contract without the consumer and entrepreneur being in the same place at the same time;
Terms and Conditions: these present Terms and Conditions of the entrepreneur.

Article 3 – Applicability
These Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the contract is concluded that the Terms and Conditions are available for inspection and will be sent free of charge upon request.
If the contract is concluded electronically, the Terms and Conditions may be provided electronically in such a way that they can be stored on a durable medium.
If specific product or service conditions also apply, the consumer may always rely on the provision most favorable to them in the event of conflicting conditions.
If any provision of these Terms becomes invalid, the remaining provisions shall remain in force and the invalid provision will be replaced with one that most closely reflects its intent.
Situations not covered by these Terms shall be interpreted in the spirit of these Terms.
Article 4 – The Offer
If an offer has a limited validity or is subject to conditions, this will be explicitly stated.
The offer is non-binding. The entrepreneur may modify the offer.
The offer contains a complete and accurate description of the products and/or services. Images are a true representation but may not perfectly reflect actual colors.
Obvious errors or mistakes do not bind the entrepreneur.
All images and specifications are indicative and cannot lead to compensation or contract termination.
Each offer includes clear information about:
- Price (excluding import duties and VAT, which are the customer’s responsibility)
- Shipping costs
- Method of contract formation
- Right of withdrawal
- Payment and delivery methods
- Offer validity period
- Data storage and accessibility
- Correction of input errors
- Available languages
- Applicable codes of conduct
- Minimum duration (if applicable)
Article 5 – The Agreement
The agreement is concluded when the consumer accepts the offer and meets the stated conditions.
Electronic acceptance will be confirmed promptly.
The entrepreneur ensures secure data transmission and payment processing.
The entrepreneur may assess whether the consumer can meet payment obligations and may refuse orders based on justified grounds.
The consumer will receive:
- Business contact address
- Withdrawal instructions
- Warranty information
- Order details
All agreements are subject to product availability.
Article 6 – Right of Withdrawal
The consumer may withdraw from the contract within 14 days without giving a reason.
The period starts the day after receiving the product.
Products must be returned unused, in original condition and packaging.
The consumer must notify withdrawal within 14 days and return within 14 days thereafter.
Failure to do so finalizes the purchase.
Article 7 – Costs in Case of Withdrawal
Return shipping costs are borne by the consumer.
Refunds will be issued within 14 days after receipt of the returned goods or proof of return.
Article 8 – Exclusion of Withdrawal
Withdrawal may be excluded for:
- Custom-made products
- Personal items
- Perishable goods
- Sealed hygiene products
- Opened software/audio/video
- Newspapers and magazines
- Market price-dependent goods
Also excluded for services such as:
- Accommodation, transport, or events on specific dates
- Services started with consent before withdrawal period
- Betting and lotteries
Article 9 – Price
Prices will not increase during the offer period, except for VAT changes.
Variable pricing applies to market-dependent products.
Price increases within 3 months are only allowed by law.
Delivery occurs outside the EU, so import VAT and clearance costs are charged to the customer. No VAT is charged by the entrepreneur.
Printing errors are not binding.
Article 10 – Conformity and Warranty
Products comply with the agreement and legal requirements.
Warranty does not affect statutory rights.
Defects must be reported within 14 days.
Warranty is void if:
- Product is altered or repaired
- Used improperly
- Damaged by external factors
Article 11 – Delivery and Execution
Orders are handled with care and delivered within 30 days unless otherwise agreed.
Delays entitle the consumer to cancel and receive a refund.
Risk transfers upon delivery.
Article 12 – Duration Transactions
Consumers may cancel ongoing contracts with up to one month’s notice.
Automatic renewals are limited and regulated.
Contracts longer than one year may be canceled after one year.
Article 13 – Payment
Payment must be made within 7 business days after the cooling-off period begins.
Incorrect payment details must be reported immediately.
In case of non-payment, reasonable costs may be charged.
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days after discovery.
Responses are provided within 14 days.
Unresolved complaints may lead to disputes.
Article 15 – Disputes
Dutch law applies to all agreements, regardless of the consumer’s location.
Article 16 – CESOP
Under EU regulations (CESOP), payment providers may register transaction data in a European system.
